A new class-action lawsuit is putting Sony under fresh pressure over the rising cost of the PlayStation 5, and the fight could eventually determine whether some buyers receive refunds. The case centers on the claim that PS5 price increases may have passed tariff costs on to consumers, even after the US Supreme Court struck down the IEEPA tariffs that had helped raise import expenses.
The complaint was filed in federal court in California by Amorey Walker and Bryce Foster-Quarles. They are asking for assurance that buyers are not harmed again if Sony is still benefiting from the same tariff-related costs in another form.
What the lawsuit is really arguing
According to the filing cited by Law360, the plaintiffs say Sony may be at risk of collecting tariff-related payments twice. Their argument is that the company could have already recovered those costs through higher console prices and could still seek a refund from the federal government.
That possibility is at the heart of the dispute. If the court accepts the claim, PlayStation console buyers who made purchases after 1 August 2025 could be eligible for compensation.
Why the tariff issue matters
The legal fight is linked to the Supreme Court’s ruling that tariffs imposed under the International Emergency Economic Powers Act, or IEEPA, were illegal. Once that decision was issued, companies were allowed to pursue refunds, although it remains unclear whether Sony has already done so.
The lawsuit does not claim Sony has confirmed that it filed for reimbursement. Instead, it raises the risk that the company may have shifted those costs to customers before any refund process was completed.
Sony’s explanation for the higher price
Sony has said the first price adjustment in August 2025 was driven by difficult economic conditions and rising production costs. Its statement did not directly mention IEEPA tariffs.
Even so, many analysts at the time still viewed those tariffs as a major factor behind the higher PS5 price. That view helped turn the console’s pricing into a broader issue about external cost pressure rather than a simple retail decision.
A wider pattern across the gaming industry
The PS5 dispute is not happening in isolation. Later price increases have also been tied to component shortages, while storage and memory prices have come under pressure.
Those conditions have already pushed Microsoft and Nintendo to raise their console prices as well. The result is a wider market environment in which tariffs, component costs, and pricing strategy are increasingly intertwined.
Sony now follows Nintendo into court pressure
Sony’s case comes after similar complaints were first aimed at Nintendo. The company behind Switch was also accused of benefiting from higher console and accessory prices.
Nintendo has reportedly been more active in seeking tariff refunds from the US government. But that has not stopped individuals from filing complaints and demanding restitution for handheld Switch systems and accessories sold at higher prices.
For consumers, the outcome of the Sony case could determine whether the latest wave of console price increases remains a market burden or turns into a path toward reimbursement. The federal court in California has scheduled an initial procedural hearing for 3 August, while some observers still consider the plaintiffs’ claims premature.
